Terms of Service
Regulations of the clinic Le Charme Sp. z o. o., with its registered office in Warsaw, ul. Stawki 6 lok. U3, 00-193 Warsaw (hereinafter referred to as the Seller) valid from 1.07.2024.

Β§1 General principles
- Persons residing in the premises of Le Charme Sp. z o. o., are obliged to read and comply with these regulations. The current regulations are available at the reception of Le Charme Sp. z o. o. and on the website www.lecharme.beauty.
- These regulations define the operating rules of Le Charme Sp. z o. o. o., clinic, as well as the rights and obligations of the Seller and the Buyer.
- The Buyer within the meaning of the Regulations is any adult natural person, legal person or organizational unit without legal personality, but having legal capacity, who uses the services offered by the Seller on the terms specified in these Regulations.
- Owners/management and Employees and subcontractors are not responsible for damage consisting in the loss, destruction or loss of property belonging to Clients/Patients, if left without proper supervision during their stay at the premises of Le Charme Sp. z o. o.
- Subject to the provisions of applicable law, owners/management and Employees and subcontractors are not responsible for injuries, loss of health or property, death, arising on the premises of Le Charme Sp. z o. o., as a result of its use, unless they are at fault.
- The Client/Patient declares that before starting to participate in the treatments they will take into account their state of health and will not join them if, due to their state of health, they could have a negative impact on their life, health, physical or psychological comfort. We advise all Clients/Patients to undergo standard medical examinations to check their general health before using our services.
- Clients/Patients are obliged to inform the employee about the deterioration of their well-being during the procedures.
- By purchasing any services from our offer, as well as by proceeding to the procedure, the Client/Patient is tantamount to having read and accepted the terms and conditions of these regulations.
- The buyer can not make a purchase anonymously or under a pseudonym, it is necessary to provide personal data.
- The Seller provides the Buyer with access and the possibility of booking services in the booksy.com application

Β§2 Working hours
- The treatment area is open from Monday to Friday from 10:00 to 20:00 and on Saturdays from 9:00 to 15:00.
- The site of Le Charme Sp. z o. o. is only available during its working hours. Fixed working hours may be subject to change in exceptional situations. The change may mean the temporary closure, shortening or lengthening of the hours of its operation. The use of some or all zones may be temporarily suspended due to an urgent need for repair, maintenance or other necessary work.
- Treatments can be performed only at the headquarters of the clinic Le Charme Sp. z o. o. o., at Stawki 6 lok. U3, 00-193 Warsaw.

Β§3 Mutual Obligations and Powers
- The entire area of Le Charme Sp. z o. o. clinic is a non-smoking area.
- It is forbidden to:
- staying in persons whose condition indicates the use of alcohol or other narcotic substances,
- the sale, administration, importation and consumption of alcoholic beverages or other intoxicating substances,
- aggressive, vulgar or inappropriate behavior,
- sales and acquisitions,
- the introduction of animals, disturbance of the stay of other persons,
- it is forbidden to take the equipment of Le Charme Sp. z o. o. outside its territory.
- In case of failure to comply with the prohibitions referred to in paragraphs 1 and 2 on the instructions of the employee or Ochrony Le Charme Sp. z o. o. the person violating the prohibition will have to leave the clinic.
- In order to ensure proper order and security, Le Charme Sp. z o. o. reserves the right to refuse to perform services.
- Without the consent of the owner/manager, it is forbidden to conduct advertising in any form on the premises of the Object. It is strictly prohibited to recommend or encourage the use of competitive services provided by other persons, economic operators or institutions, whether paid or not.
- Conducting conversations should take place in a way that allows other Patients/Clients to relax, both during group classes and individual treatments.
- If you notice any irregularities or security breaches, please notify the manager/service as soon as possible.
- Any complaints, requests and complaints should be made to the owner/manager of the clinic. The book of complaints and requests is located at the reception.
- Complaints will be considered and resolved individually. The Client/Patient submitting the complaint will be informed about the way of handling the matter within 48 hours.

Β§4 Payment
- Payment for the service provided by Le Charme Sp. z o. o, is made after the service is performed, at the reception at ul. Stawki 6 lok u3, 00-193 Warszawa in accordance with the prices in force in the current price list of Le Charme Sp. z o. o. or by making a transfer to the company account with sending confirmation of payment to the e-mail address: recepcja@lecharme.beauty

Recipient: Le Charme Sp. z o. o.
Title of transfer: name, surname and date of visit.
β - Treatments purchased at Le Charme Sp. z o. o. clinic are valid for 36 months from the date of purchase.
- The fee paid for unused services within the term and in case of expulsion of the Patient/Client from the facility according to the rules indicated in these Terms and Conditions, is not refundable. If the treatments are not carried out within the indicated period, the Buyer has no rights in respect of the purchased treatment and he cannot claim any rights to refund or compensation.
- Purchased treatments are not refundable or exchangeable for cash. Le Charme Sp z o. o. allows the possibility of changing the purchased treatments to other treatments from the offer to a voucher for a period of 1 year.
The seller also agrees to transfer the voucher to another person. If you choose cheaper treatments, Le Charme Sp. z o. o. does not refund the price difference. When choosing more expensive services, the Customer is obliged to pay the missing amount.

Β§5 Reservation of visits
- The use of any service is tantamount to acceptance of the terms and conditions.
- You can order any service by phone from Monday to Saturday from 10:00 to 20:00 or via social media and Booksy app 24 hours a day, 7 days a week.
- In order to arrange any treatment, the Buyer should:
- contact the Seller by phone, sms or e-mail, using social media or booksy.pl application,
- set a convenient date for the performance of the service,
- If the Customer is using the Seller's services for the first time and does not want to use the Booksy application registration, then he can make a reservation of the service by telephone, e-mail or social media contact.
- Visits to the Le Charme clinic can also be arranged directly with the Employees or through the Booksy app.
- Visits saved in the Booksy app are considered confirmed at the time of their approval by a Le Charme Employee.
- Visits booked directly with Le Charme employees will be confirmed by SMS the day before the appointment.
- The clinic Le Charme Sp. z o. o. sends an SMS with a reminder of the visit 24 hours before the appointment.
- It is possible to cancel the treatment free of charge up to 24 hours before its start. If the cancellation is made by the Client/Patient 12 hours before the planned visit, Le Charme Sp. z o. o reserves the right to charge you 50% of the cost of the treatment.
- In case of non-cancellation of package visits 24 hours before its scheduled date, the visit that is part of the package is considered to have been completed.

Β§6 Right of appeal
- Le Charme Sp. z o. o. reserves the right to cancel a reservation at any time prior to its commencement due to random events beyond its control. He is then obliged to submit a substitute offer or refund the receivable/deposit paid.

Β§7 Treatments
- Le Charme Clinic is a zone of silence and rest, so we ask you to behave appropriately and calmly, so as not to disturb each other in moments of relaxation.
- Those who use the treatment part are obliged to fill in the client card available at the reception before the first visit. For this purpose, please arrive 15 minutes before the time of the first treatment. Failure to complete all data in the Customer Card or lack of signature under the consent to perform the procedure automatically results in refusal to perform the service.
- Before starting the procedure, the Client is informed about the need to take pictures showing the condition of the skin or the state of the figure. If body shaping procedures are performed, measurements will also be taken. Lack of consent of the Client results in refusal to perform the procedure.
- Proceeding to the procedure is equivalent to declaring that you have no contraindications to its performance.
- Le Charme Clinic is not responsible for complications that occur after a properly performed service preceded by a properly conducted interview, in which no contraindications to the performance of the service were found and after the Client withheld the truth when filling out the Client Card.
- Le Charme Clinic is not responsible for complications arising from non-compliance with post-procedure recommendations.
- The treatments can be used by minors:
- up to the age of 16 with the written consent of the legal guardian and in the presence of a legal guardian,
- from 16 to 18 years old with the written consent of the legal guardian, the signature must be submitted in person at the reception.
- Employees of Le Charme Sp. z o. o., are entitled to stop performing the procedure if they encounter inappropriate behavior of the Client (e.g. sexual proposals, aggression, etc.) without reimbursing its costs.
- The seller accepts delays of up to 10 minutes. In the event of a long delay, the Seller has the right to refuse to perform the procedure or perform it as long as the remaining time allows. Being late does not result in a reduction in the price for the procedure.
- If the performance of the service is delayed due to the fault of the Seller, the service will not be shortened.

Β§8 Changes to offers, promotions and vouchers
- The Seller reserves the right to change the prices of the Services included in the offer, withdraw certain Services from the offer and introduce new Services and carry out promotional actions. This entitlement does not affect orders placed before the effective date of the change in the price or the conditions of the promotional campaigns; they will be executed on the previous terms.
- The duration of each promotion is limited.
- Only one promotion can be used when making a transaction.
- Seller promotions do not combine with each other. For discounted goods/treatments, no additional discount applies. In the case of running several promotions in parallel, the Buyer decides which promotion he wants to take advantage of.
- The seller also offers vouchers.
- Name vouchers entitle only the person whose name appears on the voucher to use the service.
- The voucher is valid for a period of one year from the date of payment and issue.
- The purchased voucher is not refundable or exchangeable for cash.
- In the case of using a service cheaper than the amount for which the voucher was paid, the rest is not spent. The amount remaining on the voucher can be used on the next visit.
- If the Customer wants to use the voucher for a service more expensive than it was paid for, he can pay the difference in cash or by card.
- The service arranged as part of the purchased voucher, on which the Customer does not appear without prior cancellation of the reservation, is lost without the possibility of a refund.
- Loyalty program (e.g. Gold VIP Card) entitles customers to additional discounts who have met certain conditions of the promotion.
- A VIP Gold Card can be obtained by a Client who makes a one-time purchase of cosmetology services for a minimum amount of PLN 2000.
- The holder of the Gold VIP Card is entitled to:
- 10% discount on treatments and cosmetology packages (validity of purchase in accordance with Β§4 point 2),
- birthday discount 40% (one treatment from the cosmetology offer, valid for 30 days from the date of birth),
- take advantage of the premiere and anniversary special offers (e.g. a free pre-release treatment or a treatment personalized to the needs of the Customer).
- VIP customers will be informed by SMS or phone about their right to take advantage of special offers.
- The Gold VIP Card does not apply to eye setting treatments (eyebrow and eyelash styling) and is not combined with other promotions.

Β§9 Sale of products for care purposes
- The seller sells skin care products.
- The Seller, as the Guarantor, gives the Buyer a guarantee as to the quality of the goods for the products purchased by the Buyer.
- The seller assures that the products are of good quality and are suitable for the normal functioning that can be expected of them in the context of their functional purpose
- In the event that the Buyer finds a defect covered by the warranty, the Buyer is obliged to immediately inform the Seller in writing, filling out and sending or delivering in person a complaint form containing:
- the name of the goods, the date of purchase, the value of the goods, the invoice number (VAT or other accounting document) issued in connection with the purchase of the goods,
- the term of disclosure of the defect,
- what are the irregularities in the goods.
- In order to implement the guarantee, the Buyer is obliged to deliver the goods to the Seller's registered office. The Buyer is responsible for the correct packaging and delivery of the goods.
- After delivery of the goods by the Buyer, if the Seller determines that the claimed goods actually have defects, he is obliged at his discretion to:
- replacement of the product with a defect-free one,
- removal of the defect,
- price reduction,
- withdrawal from the contract.
- The Seller shall perform the warranty obligations within 14 working days from the date of delivery of the goods by the Buyer. In the event that for independent reasons it turns out to be impossible, the Seller is obliged to perform his duties as soon as possible.
- After fulfilling the warranty obligations, the Seller will inform the Buyer about the transfer to his bank account or the deadline for the refund of cash, the elimination of the defect or the exchange of the goods for a new one, and then send it to the Buyer.

Β§10 Privacy policy and cookies
- The rules for the processing of personal data and the use of cookies are described in the privacy policy and cookies available on the Website and at the company's headquarters.

Β§11 Final Provisions
- The contract is deemed to have been completed at the moment of performance of any service at the Le Charme Clinic or the delivery of the purchased product.
- None of the provisions of these Terms and Conditions is intended to violate the rights of the Buyer and the Consumer, nor can it be interpreted in this way. In case of inconsistency of any part of the Regulations with the applicable law, the Seller declares the application of this right in place of the disputed provision of the Regulations.
- The Seller reserves the right to amend these Terms and Conditions. In case of significant changes, users will be notified via social media.
- The current version of the Terms and Conditions is always available on the Website and at its headquarters.
- In matters not regulated by these Regulations, the applicable provisions of law shall apply accordingly.
- The Parties shall endeavour to resolve disputes amicably. The consumer has the possibility, among others:
- to apply to the permanent amicable consumer court with a request to settle a dispute arising from the concluded contract,
- to apply to the Voivodship Inspector of Trade Inspection with a request to initiate mediation proceedings on amicable settlement of the dispute between the Buyer and the Seller,
- to benefit from the assistance of the district (municipal) Consumer Ombudsman or a social organization whose statutory tasks include consumer protection.
- For other, detailed information on out-of-court ways of dealing with complaints and pursuing claims, the Consumer can get acquainted on the website http://www.uokik.gov.pl.
- The administrator of personal data using the offer of Le Charme clinic is Le Charme Sp. z o. o., with its registered office in Warsaw at Stawki 6 lok U3 street, 00-193 Warsaw.
- The Terms and Conditions shall enter into force upon their publication.
